Withdrawal Policy

Right of withdrawal

The following right of withdrawal applies if you are a consumer (Section 13 of the German Civil Code, BGB), i.e. you make the purchase for purposes that are predominantly outside your trade, business or profession.

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Melanie Beck factorytoolkit, Wiesneckstr. 21, 79256 Buchenbach, email: info@factorytoolkit.com, phone: +49 (0)7661/9045659) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.

You can also exercise your right of withdrawal via our online withdrawal function ("withdraw from contract") on our withdrawal page (https://factorytoolkit.com/en/widerruf). If you use this option, we will immediately send you a confirmation of receipt of your withdrawal, including date and time, on a durable medium (by email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Early expiry of the right of withdrawal (digital content, Section 356 (6) BGB)

For a contract for the supply of digital content not supplied on a tangible medium (your shopfloor kit as a download), your right of withdrawal expires early once

1. you have expressly consented to us beginning performance of the contract before the end of the withdrawal period,

2. you have acknowledged that by giving your consent you lose your right of withdrawal once performance of the contract begins,

3. we have provided you with a confirmation of the contract pursuant to Section 312f BGB on a durable medium (by email) documenting your consent and your acknowledgement, and

4. we have begun performance of the contract (the creation and provision of your kit).

We obtain the consent and acknowledgement before the paid purchase via a separate, unticked checkbox with the following wording: "I expressly agree that the creation and provision of my kit begins immediately after purchase — before the end of the withdrawal period. I am aware that I thereby lose my right of withdrawal once performance begins."

If you tick that box and complete the purchase, you will receive a contract confirmation by email immediately after the purchase documenting both declarations; the creation of your personalised kit then begins right away — your right of withdrawal thereby expires. Without your consent, the paid purchase is not triggered; once your right of withdrawal has validly expired, there is no longer any right to reimbursement.

Payment handled by Stripe (merchant of record)

The purchase of the kit is handled by Stripe ("Stripe Managed Payments") as payment provider and merchant of record; Stripe handles invoicing and tax and provides its own purchase terms during checkout. In any case, you may address your withdrawal declaration to the contact address stated above — we will then ensure the reversal of the payment together with Stripe. Your statutory rights are not restricted by the involvement of Stripe.
